Welcome to Revival Space Contractors. These Terms and Conditions ("Terms") govern the provision of turnkey residential renovations, custom joinery, premium flooring, commercial shopfitting, and property maintenance services by Revival Space Contractors ("we", "us", or "our") to our clients. By requesting a quote, signing an agreement, or instructing us to perform work, you agree to be bound by these Terms.
1. Quotes and Cost Estimates
- All quotes provided by us are valid for a period of fourteen (14) days from the date of issue. Prices may vary thereafter due to fluctuations in material costs.
- Quotes are based on the specifications, measurements, and requirements provided by the client or assessed during site visits. Any subsequent changes to the scope of work will be charged as a variation.
- A signed quote or written email confirmation, accompanied by the required deposit payment, constitutes a binding instruction for us to schedule and commence work.
2. Payment Terms
- Unless otherwise specified in writing, our standard payment schedule for renovation and shopfitting projects is as follows:
- Deposit: 50% to 60% upon acceptance of the quote (required to secure materials and schedule mobilization).
- Progress Payments: Stage-based payments as agreed in the project proposal (e.g., shell construction, first-fix plumbing/electrical, carpentry delivery).
- Final Balance: 10% upon practical completion and snag-list sign-off.
- All materials supplied remain the legal property of Revival Space Contractors until the project invoice is paid in full. We reserve the right to dismantle or remove materials in the event of default.
- Late payments will attract interest at a rate of 2% above the prevailing South African prime lending rate per month, calculated from the due date until paid.
3. Access and Client Obligations
To enable us to perform work efficiently, the client is responsible for:
- Providing free and unhindered access to the worksite during standard working hours (typically 08:00 to 17:00, Monday to Friday).
- Ensuring the availability of basic utilities on-site (electricity and running water) at the client's cost, unless otherwise agreed.
- Securing all necessary body corporate approvals, municipal permits, and structural engineering reports required for the project. We are not liable for delays or fines resulting from a failure to obtain permissions.
- Removing all personal belongings, furniture, and valuables from the immediate work area. While we take maximum care to protect your property, we are not liable for accidental damage to un-cleared items.
4. Timelines and Delays
- Project timelines and completion dates provided are estimates. We will make every reasonable effort to adhere to schedules, but we are not liable for delays caused by:
- Adverse weather conditions (especially affecting exterior roofing, painting, or structural work).
- Delays in supply chains or material shortages from third-party manufacturers.
- Delays in obtaining body corporate or municipal approvals.
- Force majeure events (strikes, civil unrest, natural disasters, or load-shedding exceeding standard schedules).
5. Warranties and Defects
- We guarantee our workmanship for a period of twelve (12) months from the date of project completion. This warranty covers structural adjustments and installation craftsmanship.
- Material warranties (for flooring boards, appliances, sanitary ware, paint coatings, and hardware) are governed solely by the respective manufacturer's warranty policies. We will assist the client in submitting supplier warranty claims.
- The warranty is voided if the works are altered, repaired, or tampered with by third-party contractors or the client without our written consent, or if damage is caused by client misuse, lack of maintenance, or water leaks not resulting from our work.
6. Limitation of Liability
To the maximum extent permitted by South African law, Revival Space Contractors shall not be liable for any indirect, incidental, special, or consequential damages (including loss of profits, business interruption, or loss of rental income) arising out of or in connection with the project. Our total liability for any claim shall not exceed the total contract price paid by the client for the specific service under dispute.
7. Governing Law and Jurisdiction
These Terms and Conditions and any dispute arising from them shall be governed by and construed in accordance with the laws of the Republic of South Africa. Both parties consent to the jurisdiction of the Magistrate’s Court having jurisdiction in respect of any legal proceedings.
